Any tint that is noticeable would be illegal. I say it like that, because at the point where it's noticeable, you are reducing the amount of light that is coming out of the taillight, thus making it harder for other driver to see the brake and tail lights.
When I read the state code, it specifies unsafe vehicles, and unapproved lighting/equipment. The argument for unsafe has been made, that it's more difficult to see the lights and creates a hazard.
As for unapproved equipment, I can't think of a production taillight that is designed to put out less visible light than other taillights. So by tinting them you are reducing the light and altering the original equipment.
So, save yourself a ticket and a traffic stop and leave that stuff off, there's plenty of cool things to do to a car and still be perfectly legal, which is what I always tell people.
I also forgot to mention, the tint affects the reflectors that are also required by the traffic code, so 3 reasons.
